These Terms of Service ("Terms") govern your access to and use of the Farmly iOS application, farmlyapp.com, and related services that link to these Terms (collectively, the "Service"). In these Terms, "Farmly," "we," "us," and "our" refer to the provider of the Service.
By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use Farmly. These Terms govern your Farmly account and use of the Service; the license for the iOS application is also subject to Apple's Standard EULA as explained in Section 14.
Eligibility
You must be at least 18 years old to create an account or use Farmly. By using the Service, you represent that:
- you are at least 18 years old;
- you have the legal capacity to enter into these Terms;
- you are not prohibited by applicable law from using the Service; and
- you have not previously been removed from Farmly for violating these Terms, unless Farmly has expressly authorized your return.
Farmly is not directed to children. If we reasonably determine that a user is under 18, we may terminate the account and handle associated information as described in the Privacy Policy.
Accounts
You must provide accurate, current information when creating and maintaining your account. You are responsible for keeping your password confidential and for activity conducted through your account. Notify us promptly through Help & feedback or at support@farmlyapp.com if you believe your account has been accessed without permission.
You may not transfer, sell, rent, share, or create an account for another person. You may not impersonate another person, misrepresent your age or identity, or create a new account to evade a restriction or termination.
The Farmly Service
Farmly is an adult social and dating service designed to help people discover profiles, express shared interests and dislikes, publish Country Life content, interact through likes and comments, and communicate with other users. Features may vary by location, device, account, subscription status, or release.
Farmly does not guarantee that you will meet, communicate with, or form a relationship with any person. Profiles, posts, and statements by users are their own content and are not verified or endorsed by Farmly unless we expressly say otherwise.
Community Standards
You agree to use Farmly lawfully and respectfully. You may not use the Service to:
- harass, threaten, stalk, bully, shame, or intimidate another person;
- promote hatred, violence, or discrimination against a person or group;
- post sexually exploitative content, content involving minors, non-consensual intimate content, or content that facilitates abuse or trafficking;
- impersonate another person or use deceptive, fraudulent, or misleading information;
- publish another person's private or sensitive information without lawful authority;
- solicit money through deception, conduct scams, send spam, or engage in unauthorized commercial promotion;
- promote or facilitate illegal activity, dangerous conduct, or the sale of regulated or prohibited goods;
- upload malware, interfere with security, scrape the Service, use unauthorized automation, reverse engineer the Service except where law permits, or attempt to gain unauthorized access; or
- encourage another person to violate these Terms.
Context matters. Farmly may consider the content, intent, likely harm, account history, and applicable law when applying these standards.
User Content
"User Content" means profile information, photos, Dislike Posts, Topic choices, Country Life posts, captions, comments, messages, reports, and other material you submit through Farmly.
You retain ownership of your User Content. You represent that you have the rights and permissions needed to submit it and that doing so does not violate law, another person's rights, or these Terms.
You grant Farmly a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, distribute, format, and make technical adaptations to your User Content only as reasonably necessary to operate, secure, provide, and improve the Service. This license permits Farmly to show content to other users when the relevant feature is designed for sharing. When content is deleted from public display, the license continues only to the extent reasonably necessary for restricted records, shared or generated Topics, backups, safety and abuse investigations, dispute resolution, security, legal compliance, or the other retention purposes described in our Privacy Policy.
You are responsible for what you post and send. Other users may save or share material they can view, and Farmly cannot control their actions outside the Service.
Dislike Posts, Topics and Automated Safety Checks
By creating a Farmly account and using the Service, you agree that certain Farmly features may rely on third-party artificial intelligence services as described in our Privacy Policy.
AI processing is required only when you submit a new Dislike Post containing text written by you. By submitting a new Dislike Post, you instruct and authorize Farmly to send its text and, where relevant, existing or proposed Topic titles to OpenAI for Topic generation, identification of the same or substantially similar Topics, and text-safety analysis. Text-safety results may prevent publication, mark content for review, or lead to human review.
OpenAI processing is not triggered when you select I dislike this tooon an existing Topic, like another user's Dislike Post, or comment on existing content.
Farmly also uses Amazon Web Services Rekognition to analyze images intended for public display, including profile and Country Life images, for potentially unsafe or prohibited visual content. An automated image result may prevent publication or trigger review.
Farmly does not use these tools to evaluate your profile, recommend matches, determine account eligibility, or make legal or similarly significant decisions about you. Automated Topic assignments, titles, and safety results may be inaccurate, and Farmly may review, correct, merge, separate, rename, approve, or restrict content.
If you do not agree to this processing, do not submit a new Dislike Post. You may continue to use Farmly features that do not require this processing, including the Dislikes interactions identified above. More information about providers, data retention, and automated processing appears in the Privacy Policy.
Deleting a Dislike Post removes it from normal user-facing display but may not immediately erase the underlying restricted record or a Topic title generated from it. Section 10 and the Privacy Policy explain the applicable retention.
Dating and Personal Safety
Use judgment when communicating with or meeting another user. Farmly does not routinely conduct criminal-background or identity checks and does not guarantee a user's identity, intentions, statements, conduct, or compatibility.
- Do not send money or financial information to another user.
- Protect your home address, workplace, financial details, and other sensitive information.
- For an in-person meeting, consider meeting in a public place, arranging your own transportation, and telling someone you trust about your plans.
- If you feel unsafe or believe a crime or emergency is occurring, contact local emergency services.
You are responsible for your interactions with other users. Farmly may provide reporting and blocking tools, but those tools do not replace your own safety precautions.
Reporting, Blocking and Enforcement
You may report users or content and may use available blocking controls. Reports should be made honestly and should include enough information for us to assess the issue. Knowingly false or abusive reports may themselves violate these Terms.
Farmlymay use automated text and image safety checks, investigate reports, and remove content, limit visibility or features, issue warnings, suspend or terminate accounts, preserve relevant information, or contact appropriate authorities when reasonably necessary to enforce these Terms, comply with law, or protect the Service or a person's safety. Farmly is not required to take a particular action on every report and may be unable to disclose investigative details or outcomes.
Farmly Gold and Apple In-App Purchases
Farmly Gold is offered exclusively through Apple In-App Purchase. Apple processes your payment, billing information, subscription renewal, and eligible refund request under the terms associated with your Apple Account. Farmly does not receive or store your full payment card number or bank account details.
Before purchase, the App Store displays the price, billing period, included features, and whether the subscription renews automatically. If you purchase an auto-renewing subscription, Apple will charge your Apple Account unless you cancel within the period Apple specifies before renewal. You can manage or cancel a subscription in your Apple Account or App Store subscription settings.
Deleting the Farmly app or your Farmly account does not automatically cancel an active Apple subscription. You must cancel it through Apple. Refund requests are handled by Apple, subject to Apple's rules and applicable law. Farmly may receive limited transaction and subscription status information from Apple to activate, manage, verify, or restore Farmly Gold.
Paid features may change over time. If a material change affects an active subscription, Farmly will provide notice where required by law.
Managing Content and Deleting Your Account
You can edit or delete eligible Dislike Posts and Country Life posts through Me → My content.
Deleting a Country Life post removes the post, its associated photos, comments on that post, and related post interactions. Independent private-message conversations are not affected. Deleting a Dislike Post removes it from normal user-facing display, but Farmly may retain a restricted backend record for report evidence, safety and abuse investigations, dispute resolution, security, or legal compliance. A generated Topic title may remain until Topic cleanup or review.
You can permanently delete your account in the app through Me → Settings → Account → Delete account, then follow the confirmation prompts. Customer Support cannot delete the account for you; if you contact Support about deletion, we will guide you to the in-app process.
After you confirm deletion, Farmly immediately disables your account, hides your profile, revokes active sessions, and releases your email address for a new registration. Your remaining profile and account data are scheduled for permanent cleanup after 30 days. The deletion cannot be reversed during this period. Farmly may retain only limited information reasonably necessary to comply with legal obligations, maintain transaction records, resolve disputes, prevent fraud or abuse, enforce these Terms, or protect the safety and security of the Service, as described in the Privacy Policy, and will delete it when no longer required.
Your previous email address and password will no longer provide access to the deleted account. A later sign-in attempt may display the generic Incorrect email or password message. You may use the email address from a voluntarily deleted account to create a new Farmly account immediately, but the new account is separate and does not restore the deleted account or its data.
Privacy
Our Privacy Policy explains how Farmly collects, uses, shares, retains, and protects personal information, including device-provided location coordinates, Apple purchases, account safety, automated content-safety checks, and AI-assisted Topic grouping. Please review it before using the Service.
Farmly Rights and Your License to Use the Service
The Service, including its software, design, interfaces, branding, text, graphics, and other materials supplied by Farmly, is owned by or licensed to Farmly and is protected by intellectual-property laws. User Content remains subject to Section 5.
Subject to these Terms and the Apple Standard EULA, Farmly grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use. No other rights are granted.
Copyright Complaints
If you believe content on Farmly infringes copyright or another intellectual-property right, email support@farmlyapp.com with: your contact information; identification of the protected work; identification and location of the material at issue; a statement explaining the claimed infringement; a statement that the information is accurate and that you are authorized to act; and your physical or electronic signature. We may request additional information and may remove or restrict material when appropriate.
Third-Party Services and Apple Standard EULA
The Service may depend on or link to third-party services, including Apple services. Third parties operate under their own terms and privacy policies, and Farmly is not responsible for services we do not control.
The Apple Standard Licensed Application End User License Agreement ("Apple Standard EULA") applies to your license to use the Farmly iOS application. These Terms supplement the Apple Standard EULA and separately govern your Farmly account and use of the Service. If these Terms conflict with the Apple Standard EULA regarding the license to use the iOS application, the Apple Standard EULA controls to the extent of that conflict.
Apple is not responsible for operating the Farmly account or Farmly's web-based services. Questions about Farmly should be sent to Farmly using the contact information in Section 23.
Service Availability and Changes
We may add, modify, suspend, or discontinue features and may perform maintenance that temporarily interrupts the Service. We do not promise that every feature will always be available, error-free, secure, or compatible with every device or operating-system version. Where required, we will provide notice of material changes affecting paid features or legal rights.
Feedback
If you send ideas, suggestions, or other feedback about Farmly, you grant Farmly a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate that feedback without restriction or compensation. This does not transfer ownership of your User Content or personal information.
Suspension and Termination
You may stop using Farmly at any time and may delete your account as described in Section 10. Farmly may restrict, suspend, or terminate access, remove content, or refuse future registration if we reasonably believe you violated these Terms, created risk or harm, used the Service unlawfully, failed to pay applicable charges, or if action is reasonably necessary to protect users, Farmly, or third parties.
Where appropriate and permitted, Farmly may provide notice or an opportunity to appeal through Help & feedback. We may act without advance notice when immediate action is reasonably necessary for safety, security, legal compliance, or preventing further harm.
Provisions that by their nature should survive termination—including ownership, licenses needed for retained material, disclaimers, limitations of liability, indemnification, and general terms—will survive.
Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available." Farmly disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, completely secure, or that content or users will be accurate, authentic, safe, suitable, or compatible with you.
Farmly is not responsible for the conduct of users on or off the Service. Nothing in these Terms excludes warranties, guarantees, or other rights that cannot lawfully be excluded.
Limitation of Liability
To the fullest extent permitted by law, Farmly will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, opportunity, or relationships, arising from or related to the Service, other users, these Terms, or your inability to use the Service, even if advised that such damage is possible.
To the fullest extent permitted by law, Farmly's total aggregate liability for all claims arising from or related to the Service or these Terms will not exceed the greater of (a) the amount you paid to Farmly through Apple for Farmly Gold during the twelve months before the event giving rise to the claim or (b) US$100.
These exclusions and limits do not apply where prohibited, including to liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold Farmly harmless from third-party claims, losses, liabilities, damages, judgments, and reasonable costs arising from your User Content, your unlawful use of the Service, or your material violation of these Terms or another person's rights. This obligation does not apply to the extent a claim results from Farmly's own unlawful conduct, negligence, or willful misconduct.
Changes to These Terms
We may update these Terms to reflect changes to the Service, law, safety practices, or our operations. We will update the Last updated date and provide additional notice when required by law or when a change materially affects your rights. Changes apply prospectively from their effective date. If you do not agree to updated Terms, you must stop using the Service and may delete your account.
General Terms
These Terms, the Privacy Policy, and the Apple Standard EULA as applicable form the agreements governing your use of Farmly. If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
Farmly's failure to enforce a provision is not a waiver. You may not assign these Terms without Farmly's written consent. Farmly may assign these Terms as part of a reorganization, financing, merger, acquisition, or transfer of the Service, subject to applicable law. Section headings are for convenience only. Electronic notices and records satisfy written-notice requirements to the extent permitted by law.
